Welcome to AMICHA. These Terms & Conditions (“Terms”) govern your use of our website (amicha.space) and interior design services. By accessing our website or engaging our services, you agree to these Terms.

1. Services Provided

Interior Design Services

AMICHA provides:

  • Residential Design: Homes, apartments, villas
  • Commercial Design: Offices, retail spaces, hospitality
  • Space Planning: Floor plans, furniture layouts
  • 3D Visualization: Photorealistic renders
  • Material Selection: Furniture, finishes, décor
  • Project Management: Coordination with contractors and vendors
  • Styling & Decoration: Final touches and accessorizing

Service Packages

  • Consultation: Initial assessment and concept development
  • Design Development: Detailed plans, specifications, and documentation
  • Full Service: Complete design and project management
  • E-Design: Online design services with digital deliverables

2. Client Responsibilities

Information Provision

Clients must provide:

  • Accurate property measurements and documentation
  • Access to the property for site visits
  • Clear communication of requirements and preferences
  • Timely feedback on design proposals
  • Budget constraints and timeline expectations

Decision Making

  • Review and approve designs within agreed timeframes
  • Make timely decisions on material selections
  • Communicate any changes or concerns promptly
  • Sign off on final designs before implementation

Site Access

  • Ensure safe access to the property
  • Inform us of any hazards or restrictions
  • Coordinate with building management if applicable
  • Provide necessary permissions and approvals

3. Design Process

Consultation Phase

  • Initial meeting to understand requirements (₹5,000 – ₹15,000, credited toward full project)
  • Site visit and measurements
  • Concept presentation
  • Budget and timeline discussion

Design Development

  • Space planning and layout options
  • Material and finish selections
  • 3D visualizations and mood boards
  • Detailed drawings and specifications
  • Revisions as per agreed package (typically 2-3 rounds)

Implementation

  • Contractor coordination
  • Material procurement assistance
  • Installation supervision
  • Quality checks and final styling

4. Fees and Payment

Payment Structure

  • Consultation Fee: Due at booking
  • Design Fee: 40% advance, 40% at design approval, 20% at completion
  • Project Management Fee: Typically 12-18% of project cost
  • Procurement: Cost + 20% service fee (optional)

Additional Costs

Client is responsible for:

  • Construction and installation costs
  • Material and furniture purchases
  • Permits, licenses, and approvals
  • Shipping and delivery charges
  • Site-specific requirements (scaffolding, special access, etc.)

Payment Terms

  • Payments due within 7 days of invoice
  • Late payments subject to 2% monthly interest
  • Work may be paused for overdue payments exceeding 14 days
  • All prices in INR unless otherwise specified

Refund Policy

  • Consultation fee: Non-refundable once meeting is scheduled
  • Design fee: Refundable only if we cancel; prorated for completed work
  • No refunds after final design approval
  • Material purchases: Subject to vendor policies

5. Project Timeline

Estimates

Timeline estimates are approximate and depend on:

  • Project complexity and scope
  • Client approval timelines
  • Material availability
  • Contractor schedules
  • Unforeseen site conditions

Delays

We are not liable for delays caused by:

  • Client indecision or late approvals
  • Third-party contractors or vendors
  • Material shortages or shipping issues
  • Weather conditions or force majeure
  • Government restrictions or permit delays

6. Revisions and Changes

Included Revisions

  • Standard packages include 2-3 design revision rounds
  • Additional revisions billed at ₹3,000 – ₹8,000 per round

Change Requests

  • Major scope changes may require contract amendment
  • Additional fees apply for significant revisions
  • Changes after implementation phase billed separately
  • Timeline may be adjusted for substantial changes

7. Intellectual Property

Design Ownership

  • Design concepts, drawings, and documents remain AMICHA’s intellectual property
  • Client receives license to use designs for the specific project only
  • Designs cannot be reproduced, modified, or reused without written permission
  • Copyright of original designs belongs to AMICHA

Client Content

  • Client retains ownership of photos and materials provided
  • Client grants AMICHA license to use for project purposes
  • Portfolio use requires separate written consent

Portfolio Rights

  • AMICHA may photograph completed projects for portfolio
  • Requires client’s written consent before any publication
  • Client identity kept confidential unless explicitly agreed
  • Client can request removal from portfolio at any time

8. Warranties and Disclaimers

Design Warranties

We warrant that:

  • Designs meet agreed specifications
  • Professional standards are maintained
  • Licensed contractors are recommended

Limitations

We do NOT warrant:

  • Structural integrity (requires structural engineer)
  • Code compliance (client’s responsibility to obtain permits)
  • Contractor workmanship (third-party responsibility)
  • Material performance (subject to manufacturer warranties)
  • Future wear and tear

Third-Party Work

  • Contractors, vendors, and suppliers are independent entities
  • We select reputable partners but don’t guarantee their work
  • Client should verify credentials and obtain separate contracts
  • Any warranties are provided by the third party directly

9. Liability

Our Liability is Limited to:

  • Design services fees paid
  • Correcting design errors at no additional charge
  • Professional indemnity as per our insurance

We Are NOT Liable for:

  • Structural failures or building defects
  • Contractor errors or poor workmanship
  • Material defects or failures
  • Damages from acts of God or unforeseen events
  • Consequential or indirect losses
  • Cost overruns by third parties

Maximum Liability

Our total liability shall not exceed the design fees paid for the specific project.

10. Termination

By Client

  • 30 days written notice required
  • Payment due for all completed work
  • Partial refund only for incomplete phases
  • All documents and materials must be returned

By AMICHA

We may terminate if:

  • Client breaches payment terms
  • Site access is repeatedly denied
  • Misrepresentation of project requirements
  • Abusive or unprofessional conduct

Upon Termination

  • Final invoice issued for completed work
  • Digital files delivered only after full payment
  • Original documents and samples returned
  • No further obligations by either party

11. Confidentiality

Our Commitment

  • Keep all client information confidential
  • Not disclose personal or financial details
  • Secure storage of project documents
  • Confidentiality extends 5 years post-project

Exceptions

Information may be disclosed if:

  • Required by law
  • Necessary for service providers (under NDA)
  • Client gives written permission
  • Information is publicly available

12. Dispute Resolution

Resolution Process

  1. Direct Communication: Attempt to resolve directly
  2. Mediation: Engage neutral third-party mediator
  3. Arbitration: Binding arbitration in Mumbai
  4. Legal Action: Courts of Mumbai have exclusive jurisdiction

Governing Law

These Terms are governed by Indian law and jurisdiction of Mumbai courts.

13. Force Majeure

Neither party is liable for delays or failures due to:

  • Natural disasters
  • Pandemics or epidemics
  • Government actions or regulations
  • War, terrorism, or civil unrest
  • Strikes or labor disputes
  • Severe weather conditions

14. General Provisions

Entire Agreement

These Terms constitute the entire agreement between parties.

Amendments

We may update these Terms. Continued use constitutes acceptance of changes.

Severability

If any provision is unenforceable, remaining provisions remain in effect.

Waiver

Failure to enforce any right does not waive that right.

Assignment

Client cannot assign rights without written consent. We may assign to affiliated entities.
