This policy explains how AMICHA collects, uses, and protects information when you use our platform. By accessing amicha.space, you agree to the practices described here.
Overview & Platform Role
AMICHA (“AMICHA,” “we,” “our,” or “us”) operates amicha.space — a digital discovery and catalogue platform that connects homeowners with independent interior designers, architects, material suppliers, and furniture brands (“Partners”).
Important: AMICHA is a technology marketplace, not a direct service provider. We do not provide interior design, architecture, or supply services ourselves, and we are not a party to any agreement formed between a homeowner and a Partner through our platform. Engaging with a Partner is entirely at your own discretion and risk.
This Privacy Policy applies to all visitors, homeowners, and Partners who access or use amicha.space, our mobile experience, or any related service (collectively, the “Platform”). By using the Platform, you confirm that you are at least 18 years of age and that you have read, understood, and agreed to this Policy.
Information We Collect
- Identity & Contact: Name, email address, mobile number, city/location
- Account Credentials: Phone OTP for homeowner accounts; WordPress credentials for Partners
- Profile Information: Partner business name, portfolio images, service type, portfolio description, pricing range
- Communication Records: Messages sent through the platform chat between homeowners and Partners
- Moodboard & Preferences: Listings saved, styles preferred, categories browsed, enquiries sent
- Submitted Content: Photos, designs, project images, and descriptions uploaded by Partners
- Usage Data: Pages visited, listings viewed, search queries, time spent, navigation paths, clicks
- Device & Technical Data: IP address, browser type, operating system, screen resolution, device identifiers
- Firebase Analytics: Session data, event tracking, crash reports via Google Firebase
- Cookies & Local Storage: Session tokens, preference flags, moodboard state stored in browser
- Referral Data: Source URL, UTM parameters, referring domain
- Business registration details submitted during the Partner onboarding process
- Portfolio listings including project images, descriptions, tags, and pricing
- WhatsApp contact number (used to enable direct homeowner contact)
How We Use Your Information
- Platform Operation: Authenticate accounts, display listings, enable search and discovery, facilitate enquiries
- Personalisation: Tailor category recommendations, moodboard suggestions, and featured content to browsing history
- Communications: Send service notifications, platform updates, enquiry alerts, and OTP verification messages
- Marketing: With your consent, send newsletters, design trend updates, and Partner feature announcements. You may opt out at any time
- Analytics & Product Improvement: Analyse aggregated, anonymised usage data to improve platform features, performance, and partner catalogue quality
- Safety & Fraud Prevention: Detect, investigate, and prevent fraudulent, abusive, or illegal activity
- Legal Compliance: Meet obligations under applicable Indian law, respond to lawful requests from government authorities
- Business Transfers: In the event of a merger, acquisition, or asset sale, your data may be transferred to the successor entity
By registering an account or submitting an enquiry on AMICHA, you expressly consent to receiving service-related communications via SMS, WhatsApp, and email. These are necessary for platform operation and are not optional for registered users.
Information Sharing & Disclosure
We do not sell your personal information. We may share it in the following circumstances:
- Between Users: When a homeowner sends an enquiry, limited contact information (name, phone number) is shared with the relevant Partner to facilitate the connection. Partners acknowledge this when listing on AMICHA
- Service Providers: Google Firebase (database, analytics, storage), hosting providers, SMS gateways, payment processors — all under confidentiality agreements and only to the extent necessary
- Legal Requirements: When required by court order, statute, or regulation, or to protect the rights, property, or safety of AMICHA, its users, or the public
- Business Transfers: In connection with any merger, financing, acquisition, or dissolution involving AMICHA
- With Your Consent: For any other purpose disclosed at the time of collection, with explicit permission
AMICHA does not share personal data with third-party advertisers without consent.
Partner Listings & Content Responsibility
AMICHA is not responsible for the accuracy, completeness, legality, or quality of any Partner listing, portfolio image, description, pricing, or other content. Partners are solely responsible for ensuring that their submitted content is truthful, lawful, and does not infringe third-party rights.
- AMICHA reviews listings before publication but makes no warranty that listings are accurate or current
- Partner portfolios may include images of projects not actually executed by that Partner; AMICHA cannot independently verify authenticity
- Pricing, availability, timelines, and scope shown in listings are indicative only and subject to change by the Partner
- Homeowners are advised to independently verify Partner credentials, licenses, and references before engaging
- AMICHA reserves the right to remove, suspend, or delist any Partner or listing at its sole discretion and without prior notice
User-Generated Content & Licence
By submitting, uploading, or publishing any content to the AMICHA platform — including portfolio images, project descriptions, logos, or any other material — Partners grant AMICHA a non-exclusive, royalty-free, worldwide, sublicensable, perpetual licence to:
- Display, reproduce, and distribute the content on the Platform and its promotional channels
- Use the content in marketing materials, social media, press, and advertising campaigns promoting AMICHA
- Create derivative works such as cropped, resized, or annotated versions for platform display purposes
- Retain cached or archived copies of content even after a listing is removed or a Partner account is closed
Partners represent and warrant that they own or have the right to grant this licence for all submitted content and that such content does not infringe any third-party intellectual property, privacy, or other rights.
Homeowners' moodboard data and enquiry messages are private and are not shared publicly, licensed, or used in marketing without explicit written consent.
Data Retention
- Active Accounts: Data retained for the duration of account activity plus 3 years after last login
- Enquiry & Chat Records: Retained for 2 years after the enquiry is closed or the conversation ends
- Partner Listings: Listing data (including de-listed items) retained for 5 years for dispute resolution and audit purposes
- Financial Records: Any transaction-related data retained for 7 years as required by Indian tax law
- Deleted Accounts: Personal identifiers anonymised within 90 days of account deletion request; anonymised usage data may be retained indefinitely for analytics
- Legal Holds: Data subject to a legal hold or investigation will be retained until the matter is fully resolved
Cookies & Tracking Technologies
AMICHA uses cookies, browser local storage, and similar technologies to operate and improve the Platform:
- Essential: Session management, authentication tokens, security cookies — required for the Platform to function. Cannot be disabled
- Functional: Saved moodboard state, view preferences, recently viewed listings
- Analytics: Google Firebase Analytics — anonymised usage patterns, feature performance, error tracking
- Marketing: Retargeting and attribution cookies used only where you have given consent
You may disable non-essential cookies via your browser settings. Doing so may limit certain Platform features. Continued use of the Platform after being informed of cookie usage constitutes consent to our cookie practices.
Third-Party Services
AMICHA integrates with the following third-party services, each governed by its own privacy policy:
- Google Firebase: Database (Firestore), authentication, file storage, analytics. Governed by Google's Privacy Policy
- WhatsApp (Meta): Partner contact via WhatsApp links. Governed by Meta's Privacy Policy
- Google Fonts & CDN: Typography and motion library delivery. Google may log request metadata
- WordPress (Hostinger): Platform CMS and hosting. Governed by Automattic and Hostinger privacy policies
AMICHA is not responsible for the data practices of any third-party service. Your use of third-party services linked from the Platform is at your own risk and subject to those parties' terms.
Data Security
- All data transmission over the Platform is encrypted via HTTPS/TLS
- Firestore security rules restrict data access to authenticated, authorised users only
- Firebase Storage uses access-controlled paths; production assets are not publicly writable
- Administrative access to backend systems is protected by multi-factor authentication
- OTP-based authentication is used for homeowner accounts to reduce password-based risks
No method of electronic storage or transmission is 100% secure. While we implement commercially reasonable safeguards, AMICHA cannot guarantee absolute security of your data. In the event of a breach that materially affects you, we will notify you as required by applicable law.
Your Rights
Subject to verification of your identity and applicable legal limitations, you may:
- Access: Request a copy of the personal data we hold about you
- Correction: Request correction of inaccurate or incomplete data
- Deletion: Request deletion of your account and personal data, subject to legal retention obligations and active dispute holds
- Portability: Request your data in a structured, machine-readable format where technically feasible
- Opt-Out of Marketing: Unsubscribe from non-essential communications at any time via the unsubscribe link or by writing to us
- Withdraw Consent: Withdraw previously given consent for specific processing activities. Withdrawal does not affect lawfulness of prior processing
- Object: Object to processing based on legitimate interests in specific circumstances
To exercise any right, contact us at privacy@amicha.space. We will respond within 30 days. Complex requests may take up to 60 days with prior notice. We reserve the right to decline requests that are manifestly unfounded or excessive.
Limitation of Liability
To the fullest extent permitted by applicable law, AMICHA's total liability to any user for any claim arising out of or related to the Platform shall not exceed INR 1,000 (Indian Rupees One Thousand), or the amount actually paid by the user to AMICHA in the twelve months preceding the claim — whichever is lower.
AMICHA shall not be liable — under any theory of law, including contract, tort, strict liability, or otherwise — for:
- Any indirect, incidental, special, consequential, punitive, or exemplary damages
- Loss of profits, revenue, business, goodwill, data, or anticipated savings
- The quality, safety, legality, or fitness of any Partner's services, products, or work
- Disputes, delays, defects, or disagreements arising between homeowners and Partners
- Inaccuracy, incompleteness, or misleading nature of any listing or Partner portfolio
- Interruption, suspension, or termination of the Platform for any reason
- Unauthorised access to or alteration of your data caused by third-party breaches
- Losses arising from your reliance on Partner-provided information, pricing, or timelines
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, in which case the above limitations apply to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless AMICHA and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, judgements, fines, penalties, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of or inability to use the Platform
- Your violation of this Privacy Policy or any applicable law or regulation
- Content you submit, upload, publish, or transmit through the Platform
- Any misrepresentation you make in connection with the Platform
- Your violation of any third-party right, including intellectual property, privacy, or contractual rights
- Any dispute or transaction between you and another user or Partner
AMICHA reserves the right to assume exclusive control of the defence of any matter subject to indemnification at your expense. You agree not to settle any such matter without AMICHA's prior written consent.
Disclaimer of Warranties
THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
AMICHA makes no warranty or representation that:
- The Platform will be uninterrupted, error-free, or free of viruses or harmful components
- Any listing, portfolio, price, or Partner claim is accurate, complete, or up to date
- The Platform will meet your requirements or expectations
- Results obtained through the Platform will be reliable or satisfactory
- Partner work quality, timelines, or deliverables will match what is described on the Platform
Force Majeure
AMICHA shall not be liable for any delay or failure to perform its obligations under this Policy or in relation to the Platform arising from circumstances beyond its reasonable control, including but not limited to:
- Acts of God, natural disasters, earthquakes, floods, or pandemics
- Government orders, sanctions, or regulatory actions
- Internet outages, DNS failures, or cloud infrastructure incidents (including Firebase/Google Cloud downtime)
- Cyber-attacks, hacking, or distributed denial-of-service attacks
- Labour disputes, strikes, or civil unrest
- Failures of third-party service providers outside AMICHA's control
In such events, AMICHA will take commercially reasonable steps to resume normal operation as quickly as practicable.
Governing Law & Dispute Resolution
This Privacy Policy and any dispute arising from your use of the Platform shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
- Step 1 — Informal Resolution: Before initiating any formal proceeding, you must write to legal@amicha.space describing the dispute in detail and allow AMICHA 30 days to resolve it informally
- Step 2 — Arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be New Delhi. The arbitration shall be conducted in English by a sole arbitrator mutually agreed upon by both parties
- Step 3 — Courts: If arbitration is inapplicable or a party seeks injunctive relief, both parties submit to the exclusive jurisdiction of the competent courts in New Delhi, Delhi, India
You waive any right to a jury trial or class action in connection with any dispute related to the Platform.
Changes to This Policy
AMICHA reserves the right to update or modify this Privacy Policy at any time at its sole discretion. Changes become effective immediately upon posting the revised Policy on the Platform with an updated “Last Updated” date.
For material changes, we will make reasonable efforts to notify registered users via email or an in-platform notice at least 7 days before the change takes effect. Your continued use of the Platform after a change is posted constitutes acceptance of the revised Policy. If you do not agree to the revised Policy, you must cease using the Platform.
We encourage you to review this Policy periodically. The current version supersedes all prior versions.
